If the latter, then the seller likely has no leg to stand on.Your contract will likely have Specific language about you “not depositing the EM” not “your broker showing evidence”.Something else is going on, EM is typically due at signing or within a few days, this sounds like weeks later.

He said it was his legal right to do so because of the language in the contract that said I had a 3 day period to cancel the contract, and, after that point, if I decided not to have the work done, that I forfeit my deposit.

It's a 5 plex but city officially sees it as a 4 unit because when the original owner filed the paperwork that was the classification given.My seller tried to get a variance, but city said they wouldn't qualify.

You should request the official reports form the Property Inspector and  then inform the seller of any necessary repairs that you want done.
