There is no one set way that I'm aware of, there is just what both parties agree to.We signed a contract to lease the property from the owner for a 6 month period so he can find a property to do a 1031 exchange.

Changes the picture somewhat; everyone should evaluate their own model.Also there are countervailing concerns to be aware of to find one’s own balanced position on this:Yes I’m aiming at the “crappy” end of the market where a plumber like me can add value adding/ fixing bathrooms and kitchens; where prices are cheap still and returns especially after adding value can be much higher, and also I’m a big believer in not just maintaining but improving your properties, which all fattens the capital expenses budget.

His exit strategy is longer-term buy&hold.The goal is to structure a deal where we perform owner financing on a property that has a backing mortgage.I haven't talked to the lender about it, but was curious about whether, in this case, that was even possible.I believe our vibrant community here can provide useful perspectives, and thanks in advance If I understand the question correctly, you would go ahead and do the refinance to long term financing, (be aware that the note probably has a "Due on Sale" clause), you would meet the minimum occupancy term requirement, sometimes 6 months, sometimes 1 year, (read the agreement) and then sell to your buyer on a Wrap.

Write them a letter and explain that you believe you both share responsibility for the cancellation and had they done their job with more upfront information, which is an easy thing in their field, both parties would have very early on been aware of the zoning/appraisal incompatibility.
