Of course, there might be multiple other sub2 clauses that don't just relate to paying off the sellers mortgage - eg. could be County Code violations or back Taxes.

My concern is the seller said there are a few code violations so i immediately thought flood damage but they said it was just that that the previous tenants had to many pets and it needs kitchen cabinets and some floor work in the bathroom.

If you do that, you could add a little to the rent to compensate you for your inconvenience.Also, build in a service fee (ours is $20) for each time you need to serve a legal notice for a lease violation.
