I have applied the late fee and given her formal notices but she just keeps saying "I'll take the late fee, I can't pay it right now, I'm applying for assistance which I should have soon." 

In general, as long as you've served notice as required by your lease agreement (or your state's tenant-landlord law) then you should be fine.  

In the future I will probably either fly, if I have enough notice its pretty cheap on southwest, or I'll get a room.
