If that's the case, you'll have to get a transactional loan.Even if you don't need to have the transactional funds in place, you'll need to verify who the certified checks should be made out to and know that the title company is comfortable doing a double close.

The disclosure has a hand written page on the back that's in Chinese and the listing agent needs that page signed.Not comfortable signing a page I can't read, person at my realtors office said it look like a lost of what they fixed and to what condition it was fixed.

As others have said, it will probably mean you end up paying the 40K, but if you are comfortable at the price and are considering 40K as your "Best and final" anyway, then I don't see a big downside to try the escalator bid.
