I have check with the courhouse on background info & suchand will be going to the auction to bid on it.*** My question is: Can I buy this directly from the lender before the auction?

Even if a private lender would agree to this madness, what you are doing is hiding the $70K that is not truely your asset (technically it is your asset, along with an unsecured, undisclosed $70K liability.)
