If anything, it sounds like the receiver/trustee would have to reserve the first $10k of the purchase price and give it to the homeowner before distributing the money to the lien holders.

What I would do is to order (have the seller order), a pay off from the note/s holder/s, showing what is owed on the property to include taxes and legal fees.

It's gone.The foreclosing lien holder will normally bid an initial amount, and therefore buys it if no one else bids, and it is still subject to any superior liens.
