Tanner -I've had agents disclose that they are in fact representing me, yet still fill out the P&S agreement in the sellers favor (I refused to sign and I fired the agent).

This area is within easy commuting range (via interstate) of metro employment areas, while being very appealing to those favoring rural living, and there is very little housing available in this price range in the area.They tell me that this type of home can be financed conventionally (still need to verify this), and we'd create our own comps after it got rolling.

Not sure how well that would stand up in court if someone wanted to challenge a contract.If he is dealing with a listed property there is no way the agent will advise the seller to take an offer with no deposit and they will probably want to see at least a few hundred dollars for it.Deposits are usually pretty meaningless IF you have any contingencies since only in the most lopsided things possible do those rules ever favor the seller.

well that's different then :-)If you can afford $5k down plus all closing costs, you could still be very persuasive at 0% interest and whatever your moat favorable terms are.

The contract we were given by the mover is not acceptable (too much money upfront, no provisions for lien releases, not enough detail about what is going to be done and by whom, no stipulations about insurance, etc...the contract favors the mover/installer and has no protections for us, which makes sense since he prepared it).

Just because the definition of Loan Originator has not been nailed down yet, and there is hope that the MHI Dodd-Frank Task Force may be able to get favorable changes does not mean you should wait to deal with Red Flag, Safeguards, et al.
