Have you run a title search on the property to see how it all shows up from w/in the official land records?

Win - Win.It is really just a matter of finding the deals, and then seeing what works.....You just have to make sure the numbers work...I see so many things for sale that are WAY overpriced, and not from a market perspective as much as a cash flow perspective, so be careful and do your due diligence.

Basically I'm thinking it would be a win-win since he put a full price offer and I can potentially get it for a less?

I'm worried that if there is no lien and no judgment but there is some on going litigation that I and title company do not know about, that the property could be hit with a lien or be transferred over to the evicted tenant because he wins a case claiming he is the rightfull owner of the property for whatever reason.Maybe unlikely but probably a valid concern right?

Btw is it normal for a landlord to win an eviction case when the totally innocent tenant's only lease violation is paying rent two days late?  

It seems the bank was sloppy win their research when they made the loan, then so we're you.
