If they don't know each other, it's more likely one will flake and the others will try to refuse to make up the missing rent and you'll have to take everyone to small claims court.

Because a partner's approval can not be unreasonably denied, not a good tactic if you get sued and everything in a contract needs to be first class, needs to hold up in front of a judge, otherwise, why have good contracts.The financing contingency is the strongest one you have, it is customary, it's been tested in courts, it allows a lender to say no for many reasons, if it has a bad inspection it needs to be fixed or they don't lend!

That's why you need formal documentation about how the business will work.If someone thinks they've been treated unfairly and you end up in court, having the proper private placement memorandum will be important, too.

It's vague and generally not enforceable in a court of law.You could be talking about a broken appliance in the garage or a 5,000 refrigerator in the house etc.I just can't stand sloppy contracts that are vague.

This was put into law in California by a court decision in Marin County.Now if your going to be active and take the opportunity to list properties you find that are not good investments at the price offered you can go to plan B and list them and pay your overhead.
