However, irrelevant of title insurance this situation shouldn't take long to resolve.One way is for the Trustee to receive an order from the Bk Court authorizing the sale of the property free and clear of all claims of creditors and the lenders claims are transferred to the proceeds and the two battle it out after the sale.Even if the property isn't sold before the lender's claims are adjudicated, it shouldn't take long to resolve the issue since the Trustee is considered to be a Bona Fide Purchaser without knowledge of any non- record interests. 

My first thought was the same as one of the other posts - if the vent to the outside is clogged the same "clothes not drying" issue would re-appear.

It depends on the state, the actions of the borrower, the “bias” of the particular court should the borrower file an “action” (bankruptcy, wrongful foreclosure, temporary restraining order, non enforceability of mortgage or deed of trust, etc.).

I believe every court system has a method of withholding rent when landlords are not fulfilling their obligations.

Take photos or video and bonus points if your new tenant appears in the photos or video- Tenants Personal contact info (cell and email)- Tenants Emergency contact info - Proof that utilities were moved into tenant name.

I'd prefer not to take things to court/sue.

I understand Newark CAN be a hassle for newer small investors, due to renter friendly courts and low potential low quality tenants.

Your present home that you will be vacating already appears to have pretty good cash flow potential (unless there's some hidden maintenance or capex that we aren't seeing).
