I believe the better place to control the duct work is closer to the furnace, because it helps prevent the heated air from even traveling down the duct, to a closed vent.

As long as it's during the day and not during quiet hours (usually 10pm - 7am) then you're stuck.You can't discriminate against kids, but you should always warn people looking at the upstairs apartment that their noise travels downstairs.
