@Ben O'Neill  The simplest thing to do is specify under address the room and use of common areas.

If you are a note investor how many notes do you look at for each one you make an offer on?  

Insurance would cover it, I would pay the deductible, and no assets would be lost.If you are in an area like San Diego where people are more likely to sue, a judge is more likely to find you guilty, and the payout is expected to be higher, you may consider an umbrella insurance policy.

I would also look at how much are you going to make on this and where are the headwinds of the market moving in this area.

Contact a reputable RE attorney in the area where the PM is located.

Realistically, if you have a connection to all the vendors necessary and the property is in an area where the quality of tenants will be good, you do not need a PM.
