Your attorney can explore your options such as placing l lien on the property to taking the seller to court.Fair enough - I'm confirming my train of thought is simply in the right place before I consider getting an attorney involved.There was a no new contract.

The bottom line is if your insurance company won't cover you, it really doesn't matter either way it is a no go. 

For the relatively small cost of having an attorney review things like the title report, title insurance exceptions, property insurance and borrower documents, as well as preparing the RIGHT documents so everyone knows what is expected of them, it seems like a no-brainer.  

A related downside I just learned is that while you don't receive any cash flow, you receive a tax liability because the cash flow that would have been distributed to the investor is used to pay down the loan principal.The more I learn about these products, it reinforces a no free lunch rule of the universe.I'd love to satisfy my debt obligation, take no cash return, have no tax liability and am willing to trade yield over time.
