Based on the legal advice I've received, it seems that the landlord cannot add to the list if the damage was not hidden during initial inspection.

If they did that and gave you written instructions to not mess with it during the winter and then you did mess with it, that might be on you.

There're still so many opportunities even in your area, the key is you need to find that hidden gem.
