They said it's be a commercial loan, because it's an LLC, but they said they don't do commercial loans on residential properties.

My presumption is that you have this property in an LLC and because the LLC doesn't make money, you cannot refi.

They tightened the law in a series of laws in 2008 so that now you only get to prorate the gain between the time used as primary (tax free) and rental (you'll pay tax on this portion).

By trying to limit their liability with an LLC, they have done exactly the opposite by having a property with no insurance policy on it.

Our current LLC is set up in Wyoming and are looking at adding the properties in Texas to the Wy corporation or setting up a new LLC for the Texas properties.
