If you can find a way to convince the seller that this will not be an issue with your contract, you can beat out any cash offer that is lower than yours.

(If not, that should be an automatic free out for you and your EMD, although you should be even more interested at the new lower price.)

@Jeremy Nault  Like mentioned above, it shouldn't be an issue to do a cash out refi on an investment property.
