Like you've stated, while there are no tenant/landlord laws regarding second hand smoke in Florida- landlords are required to provide safe and adequate living conditions for their tenants by way of implied warranty of habitability.

The BEST approach by far is have the home pre-inspected and with a warranty and have your Realtor have BOTH of those ready and available on your kitchen counter at round -up at the viewing.

Lastly if something has MUCH older major mechanicals I don't mind to ask the seller to pay for a home warranty for a year in the hopes that those items might go out sooner than later!
