I don't know how landlord friendly your state is but trying to convince a judge to evict a tenant over an outdoor bag of garbage (with no municipal violations/fines) is going to be pretty difficult most places.

No views, no outdoor space, no kitchen, no table to sit and play games or share a bottle if wine, etc.

Then you'd know that they were not wasting your oil heating the outdoors, or creating a whole-apartment sauna. 

I was told by the landlord/manager that the cat shouldn't be outdoors so that is what I was going by.

I have beautifully updated up and downstairs, and am going to wrap up the outdoor landscaping minimally in springtime. 

I have already thought about remodeling the kitchen during the summer so that I can utilize the grill and outdoor eating space.
