I realize that an occupied foreclosure requires the buyer to evict the current occupants in order to obtain possession, so I am wondering if Cook County is better about evicting tenants when the property is foreclosed/sold than if the original landlord or lien holder is trying to evict the occupants.

This means if the property or any portion of the ownership are sold the mortgage holder has the right to accelerate the mortgage and have the entire balance due immediately.

A TIC (tenants in common) can also avoid lending issues as owners in fix and flips or rentals, a half interest might be purchased on a $100,000 property for $25,000, whatever and you're in title under a TIC Agreement.Back to your needs, just know that any investor taking part interest in one note is called a participation loan and all note funders, holders, buying in are considered lenders.

And, you do know that the modification of any note by a note holder is an extension of new debt, just because you own the debt doesn't exempt you from Dodd-Frank, so again, work with a servicer for modifications.
