I can get assignee to put it up when he signs assignment agreement but I just don't like them trying to force me into more risk than I negotiated.

You might not be able to force them out now, but you can tell them you don't think the relationship is going to work and 'offer' to tear up the higher lease if they will move out.Getting them out now will save you a lot of headaches laterandy
