Your accountant should figure out what assumptions the State may have made and they will need to generate the state returns for 3 years in order to calculate if the state is correct or not.

If I can contact the buyer and seller, and we agree that I do assumption of loan (in leu of foreclosure to buyer) is there specific paperwork to follow in the state of CA, or how would one stop the foreclosure proceedings through a title company, or what avenue does it have to legally take?

My end goal is to get into new constructions, however I'm not sure that my credit is currently good enough (<600), so my assumption is that my best bet would be to start with an auction property.
