I've been talking to a couple local real-estate attorneys and the biggest hurdle IMO is going to be owners who don't redeem with in 3 years but then fight the suit to quiet title.

The broker considers an 8 cap apartment after fixing up to be outstanding in this area.Considering the shaky kind of financing available for apartments and the possibility of caps shrinking with increased rates, and the locked in upside of the property I own now, does a trade make sense for total return?

If you can prove that she missed one or two key pieces of data, you may be able to get the whole thing thrown out or a review of the entire report.Unfortunately, at this point, it's an uphill battle -- appraisals are tough to fight once they've been sent to the lender, as the appraiser will have to admit s/he made a mistake or missed something in order to get it changed.
