Options will be considered an installment sale if not properly drawn giving a reason why the sale cannot be made at that option date, see your CPA. 

Lots of brokers have properties which they don't get the listing, but they know a potential sale can happen.  

Is it determined by nearby sales within 6 months?

What does the owner need out of the sale (time, elimination of a headache, $, etc).

My claim seems equivalent to the  process you would use for the lien release of a private lender first or second mortgage.Who do I work with in the transaction to allow the sale to go through without a cloud on title, but also get paid?

Usually you will lose around 7% in sale with commissions, title fees, etc. (~15k) Additionally, sounds like you are living in it.
