The tenant is okay with removing the trampoline but is against getting rid of the jungle gym claiming that its her tenant right to keep her property there because she pays for the yard. she has yet to sign my new lease and the previous "management" never had an official lease explaining such discrepancies.

Each state is different but for me I like to reconcile the tenant deposits and the owner reserves separately every month to make sure there are no discrepancies.

I do believe that the GIS is correct and the discrepancy is while recording whoever surveyed it at the first place.I called up County surveyor's office and they want me to re-survey and if any dispute comes up then they want me to resolve with the neighbors.

Houses are listed all the time with sq ft discrepancy.. the county will have one thing an appraiser will have another and the agent put another sq ft in the listing.Bottom line though I suspect this DD money was very small and a lawyer would be WAY over kill cost more than the money at stake..
