I think your lender is charging points to give you this rate, which I would not agree with.

Some Community banks limit the number of Properties (or $) to each Legal Entity or charge Audit fees to review your LLC structure.  

(Of course, you don't have to tell them you are charging above-market rent, but they will know it.

Attorneys have different rates, call around and ask for consulting rate charges and have all your documentation in hand.
