First off, Coldwell Banker isn't even a bank .. they are a real estate brokerage.Secondly, it doesn't matter who gives you the loan, it will be a mortgage on the property, which means it's not Free and Clear until they are paid off in full and release their lien.

If so I would think they might have the ability to release it via a bill of sale.

But perhaps, the existing mortgage was a LOC, or it was Modified, which would mean the previous mortgage wasn't released, but the new higher amount would be to be contested.
