My question is, can I give the 30 day notice to vacate since it is a month-to-month contract right away since I will be living in the building and the tenant is refusing to sign the new agreement and that the old contract as well as my new contract are both month-to-month terms?

I noticed that the payment was never pulled and on my mortgage portal it says "Payment Date: Servicing Transferred" There is a notification that says "Please refer to your servicing transfer letter for more details."

I like the idea of having a clause in the lease stating that option 2 will go into effect if a notice of potential citation is received, but am curious if the tenants would end up just falling behind on rent because they have already requested that this first fine be taken out of the deposit when they move, due to current financial hardship.

@Bertha Spezzia - Are you saying that there is a permit violation or that you just noticed that they did certain work without pulling permits?
