However in this case it sounds like the lien has been released so the question is moot.yes foreclosing a junior lien does not remove a senior lien not matter what it is.. although in practice its pretty rare to have IRS lien senior to bank loans.. maybe a private loan where a lender never requested lenders title insurance.Not as rare as you might think, liens of all flavors get missed all the time in title searches.

I'm not in a hurry to buy but my needs are pretty specific so if I'm wrong about everything here, I don't want to miss out on what was right in front of my face.

Am I safer at say 65% LTV or just missing out on an additional 30% cash out to use in various ways, including security against future problems as well as investing for more cash flow?
