The use of "negligence" in your prospective tenant's language counter is much to broad of a term and leaves too much open to interpretation, confusion and liability on your end in the event of a dispute (which will happen).

That is unless you want to invest in lower end cash flow properties, but you need to be very careful with that.Of course, this leaves out a lot of detail and there are of course exceptions, but those are the broad strokes of where I would be cautious about.
