@Jennifer S.I suggest asking the benefits provider for a written explanation as generally most pensions can be transferred to an IRA, or a retirement plan such as a solo 401k plan if you are self-employed.

If they decided to sue for it and you don't send that you will lose.When you bought the property transferring the deposit should have been part of the deal, if not then your real estate agent and/or the title company did a bad job.
