It sounds like in some areas the buyer can say "I want 500K off" and the seller can say "No" then the buyer can just wait until the closing table (weeks later) and say "OK 250K off", "How about 120K off?"

It sounds like since the property sits on a slope, the water table on the uphill side of the basement is actually higher than the basement floor, thus infiltrating.
