Just make sure you look at recently sold properties in close proximity to the subject property.

@Eamonn McElroyThoughts on this statement:“While depreciation not claimed, under allowed vs allowable, would not be subject to recapture taxes, the unclaimed depreciation would reduce the basis in the property”.I have a CCH or Bradford article on this subject I can link later, but cannot also remember if this was specific to a home office depreciation deduction.Economically, why someone would not claim depreciation is beyond me.

I am curious for anyone owning rental property down there how the landlord tenant laws are and if you have any resources I could turn to for some information on the subject.

This is a fun topic for me, since I'm an architect and this is a hot topic for discussions it gets brought up fairly often by clients.

Although I do think it's not a really black vs white subject, there are numerous places that cash flow and appreciate.
