Is this Florida HOA violating laws with their application / approval process for a new home BUYER....We are in the process of purchasing a unit/Condo within an HOA in port st lucie Florida..The HOA needs to provide a certificate of approval for the sale to close.. the seller already accepted our offer and we are just waiting for the close date and the certificate...On their application they are asking us a lot of private personal information such our yearly earnings, where we worked, SS#'s, A copy of our sales agreement, they also want to do a credit check and background check on us even though we are not renters... ??

You already are getting inspection and title insurance.Since you mentioned it's a FSBO, then @Wayne Brooks gives good advice in placing the deposit with the title company or closing company.Now, there might be a need to get some authorizations for third-party disclosures (due to FSBO, no agents to assist) for things like any loan balances, unpaid taxes, unpaid lienable utilities (in my area there is something called tax and utility certification).

I hire mostly vendors, and get a copy of certificate of insurance before they start work,, some are regular contractors so they actually send it to me each year..I still have workers comp and it would cover me, and other family member, or the once in a blue moon general labor guy, that works on property, I don't think I'd risk being without it.
