Kevin, It's tough because your rate is really good on the first, however you do need to refinance that VA loan into a conventional loan to free up your VA entitlement. 

If they provide data that proves otherwise, you can adjust if those numbers are credible.

The initial points can be a little higher than a traditional Conventional loan, but that's the cost of doing business to being able to get a loan without proving any of your income.

While that is technically mortgage fraud, it would be really hard to prove there wasn't intent to live there.

Since I am new I'm not sure what trouble I will have to go to to "prove" this is causing the damage.

@Lauren Gomez yes regularly, 1031 requirements are tough to meet. 

If you are not looking to do the 5 or 10 years to Retire with 100 Doors Plans, then, plug in your numbers and prove out your Plan, with and without Appreciation for the Future.

this is a tough spot to flip...I've seen a lot of investors get burned in this neighborhood on incorrect ARV's or over budget reno's...its interesting to see, though...and maybe some lessons learned on this one. 

We refinanced again in May of last year, which would explain why the 2011 recording would show as cancelled, but without that recording from 2020, could I prove that I own the property free and clear and receive the funds from the sale and not be liable to pay the lender?
