Although there is an apprasial at 175k, there is no guarantee of what the market will bear.

According to Title 6 Chapter 83 Section 49 subsection 2 paragraph (b) IT ACTUALLY STATES (b) State the name and address of the depository where the advance rent or security deposit is being held, whether the advance rent or security deposit is being held in a separate account for the benefit of the tenant or is commingled with other funds of the landlord, and, if commingled, whether such funds are deposited in an interest-bearing account in a Florida banking institution.

Who owns the property and the sale of the property has no bearing on the tenants obligation and violation of a contract. 

This doesn't appear to be an easy refi.  3 homes on the same parcel can be a bear to bank finance.

If I had done it I would have kept all the rent in an (interest bearing) account in case something like what you mentioned came up and I needed the money.
