I don't know your market but it sounds like you have a great setup to purchase a property and use remaining equity/cash to rehab a property.

this sounds like a very unlikly legal battle  expensive and not worth it.. plus probably cant tie up the property.. 

The seller might miss out on a buyer because you had it tied up.  

We qualify for "available" when we list to ABnB or VRBO because we can pull our listing whenever we want and so therefore it remains "available", at least that's how he explained it.
