This is in Texas.I have a situation where some domestic violence has occurred and the wife has told me he trashed the house.   

Depends on the facts and circumstances that occurred leading up to the disposal.The burden is on the tax payer to show that the property was purchased as an investment (capital gains) versus a business (flipping).  

Maintenance is for small repairs and upkeep of the property that occurred and claimed each year.  

That said, this strategy does mitigate the risk of conflict with your landlord which is far more likely to occur than a bylaw fine (at least in my area).
