As a guy that was in the crash of the late 90's as well as the crash of 08' and in the banking industry, I can say at least from my perspective that it's a different world and in my opinion, one for the better as far as laws and regulations go.

That would be a violation of the Real Estate Settlement Procedures Act (RESPA) and they could both get fined and lose their licenses.The primary reason a real estate agent recommends a specific lender is because they have a good track record with them.

That means using a Trust or LLC or you mom or wife to loophole into exceptions that is not at arm's length (no other relationship involved with a party behind the scenes benefiting) will be treated as a regulated activity.

You don't want to do any long term installment contract without an attorney, if you can find one to do one.The DOS and FHA regulations are anchored in federal law, not administrative "discipline" and administrative rulings carry the weight of federal law.

I found the 180 day rule in the Rev Proc 96-31, Section 5 as follows:   "A taxpayer makes a change in accounting method under this revenue procedure by completing & filing a current Form 3115 in duplicate.
