So you would ask for, i.e. 45 day feasibility period (the time in which your deposit is still refundable) and then if by day 45 you feel confident and can start to move towards a close, then you will ask for a certain amount of time to close, but during that second timeframe, the deposit is now NON refundable.

Not to deter you from getting an LLC, but I would look into getting a Umbrella Policy for your AZ home and get an amount of coverage that you feel is necessary.

The longer it was rented out can’t hurt either since it’s supposed to be an exchange of one investment property for another investment property  Your probably going to need a 1031 expert like @Dave Foster or a CPA to weigh in if you don’t have one.

If an expert doesn’t weigh in and you aren’t excited about paying someone else to list it I would certainly get an official opinion by your CPA but even that isn’t a guarantee.
