My understanding was always that the laws are not different for 4 family and under unless the landlord lives there. 

You don't want a person living in a place with that in the basement.

They don't evaluate the actual floorplan, quality of finishes, view out the living room window, yard condition, the barking dogs next door, or hundreds of other data points.
