In that agreement you have the power of sale, if a owner partner backs out, they are liable for costs of court and collections of your equities as your cash contribution along with damages at some stated amount.

Now if you are using your contract (which allows you an out) and the agent will allow you to do it - then more power to you...just not sure why they would do that.If the agent is selling their own property - it is unlikely that they will take a commission.
