@Sean Peters I think your attorney friend is your best resource in this, but if your tenant has an option to renew that's a part of his lease, I think you have no choice but to honor it - unless you evict for breach of contract.I suspect that if you do not evict and then raised the rent beyond what the contract allowed, a court would find you in breach of contract.If you do evict, be sure that you have your documentation complete right down to the letter.

Eventually you'll also need an attorney (I went with the one provided by lender which was a VERY good choice), and a home-owners insurance provider (I used multiple agents until I was happy with coverage and price (DON'T under insure).

Keeping in mind that every month the property is held on to, he goes deeper and deeper in the hole.Holding out any longer is not investing anymore...it's speculating.If you are headed to a particular destination of great interest, in a rowboat, and about 50 yards off shore you realize the boat has a leak and is sinking...fast, you have two choices:1 - You can row faster, and bail even faster (wait, no partner in the boat, so you have to choose between those two...I suggest rowing like you've never rowed before).
