Our attorney advised us to check title early and often and we added language to the PSA that specifically protected us should the title be affected while we were still under contract.

Rent control is put into place politically by predominantly Democrats who think they're actually trying to help (or pander to their voting block) as a means of "protecting those who could get forced out by higher rents" I believe is what I've heard most over the past couple decades I've been at this.

If  You currently own the apartment building, it really shouldn’t make a difference for tax purposes.Ideally you want to form the LLC in the state where the property is located to get the best asset protection.
