Maybe also file a lis pendens to cloud the property until this is resolved.Document everything you have on the matter.

This is something I am not personally worried about as I have a very high deductible and would not likely file a claim, and the ACV is much cheaper than Replacement.

I got it back in my instance by calling my agent and dictating exactly what I wanted him to tell the sellers agent - "The owner WILL sign the EM release by close of business Friday or I WILL file suit at start of business on Monday".

Normally this boot would be taxable but since you qualify for the 121 exemption your accountant files the appropriate form with your tax return and that $500K is tax free.Meanwhile the remainder of the gain ($300K ish) and all depreciation recapture go into the 1031.

You might be able to file a complaint with the city for safety violations, but I would ask the landlord to fix it first.Again, my advice is to first come current with rent.
