believe me I have sat in front of a state regulator on similar issue with my attorney telling me we were right and the regulator saying NOPE.. guess who won. it was not me that one cost me 30k.Or I could have spent another 100k at administrative law court to argue against the state as to my lawyers interpretation vis a vi the state.the reality is if a regulator takes a swing at you .. not many folks are going to be able to stand up to it..

The property WILL be in my name AFTER probate however the courts are "taking forever". i talked to the person that does (has done taxes for the LLC for years) and he doesnt seem to know how to handle this situation. wanted to see if anyone here has any insight on what should be done for 2016 taxes on the LLC with "no owner".on a side note: i drove an X miles last year managing the LLC and the "LLC" did not pay me. would i allocate the miles on my personal taxes or for the LLC expense?

Google that.Some leases have the terms that permit partial payment on late or past due rent by tenants even after the eviction action has been filed, some courts don't honor that and make you start all over again so don't get stuck.Sounds like with the "other lease breaches" you still want the tenant to leave so I wouldn't jam up the process and get a "DO OVER" at this stage of the game..
