Stopping Accepting Rent for eviction purposes.

Hi All,

Quick question, I spoke to my attorney this morning in regards to a tenant where has been given 10 day notice for various different breaches - one breach is paying only partial rent for this month. I want to evict due to the number of issues with this tenant. The tenant texted me on Saturday saying he will pay the remainder tomorrow.

The attorney says that not to accept this - which is fine I do not want to delay eviction so it is best not to accept it.

My question is should I let me know tenant know that I closed my bank account where he does direct deposits to? (I closed it so to no longer accept partial payments) and that he should mail me a check to the new PO box I opened? (I do not plan on cashing it)

Or should I tell him outright I am not accepting any more payments? (I prefer not to do this - as I do not want him damaging my property on purpose)

I forgot to ask that of my attorney but I thought Id ask anyone else their opinions.

Eviction will be filed this Friday coming since the 10 days will be up.
