If your tenant believes that and stays in possession, you will either have to wait 30 days for them to move out, or file an eviction lawsuit and possibly wait longer than 30 days if everything does not happen as quickly as it possibly can.

It's already been said but I'll echo...terminate the current tenant's lease and create an entirely new lease when the new renters take possession. 

I don't mean "clean" by it doesn't need rehab, I mean clean as in you have identified and disclosed any material defects in possession that would ruin the value of the asset?
