FYI, you can also assign a contract back to the seller and once you find the tenant buyer and collect the fee, have the seller sign a general release which releases you from any obligation.

There are only a few documents required to get this type of loan done and we won't allow the funds to be released on our side without the C party having their part of the deal signed and their funds in escrow before the A-B closes and we do these in Florida all the time so I hope this helps.

There are lots of As-is purchases here in our market and with those, the seller is just writing in 'no representation' on each line item in the disclosure form and if it's a bank selling an REO, you're not even getting a formal property disclosure form from them, just a statement that is releasing them from any/all liability with the conveyance of the property to buyer..

Bad idea - pay rent first then you can talk about hiring him if it needs paint - make sure you approve the paint colors - if he paints it bright purple then you will have to have it repainted upon move out and it will cost a fortune to cover up the purple paint - also think about this, if he does a bad job and you don't pay him, he can file a mechanics lien on the property until you do UGH - you don't want that - have the proper docs in place before you hire anyone - scope of work, pay agreement, general release and final paycheck - this will protect you

I know the main agreements when doing a lease option assignment are the lease and the option to buy contracts along with the assignment agreement or release agreement My question is once the end buyer decides to buy with the original seller will they need a new purchase and sale agreement or will the original option to buy agreement suffice ?
