agnes, you are wise to read up on all the forums on this perennial topic...it can work well for some cases but create unintended consequences in others as your are already seeing ..I won't rehash all the forums chock full with good points on all sides, but a search of due on sale or llc, etc can be instructive....

Escrow would also hold the original note and present it to me if the assignment is recorded.The escrow instructions would have to be clear about what’s a default, how it’s claimed, what the remedies would be before recording, and probably a hundred other things a lawyer could help you with.

Keep in mind that ALL offers do not need to be submitted if the seller has given specific instructions, such as "only offers over XXXXXX dollars shall be submitted", but in such case the listing agent should notify you of such limitations.You already informed the bank, she may not get another listing from that bank if you push those buttons.I'd chalk this one up and walk, but I may not dealwith her again.
